Worker Rights

The employment and recruitment of domestic workers in the UAE are governed by Federal Decree Law No. 21 of 2023, which amends provisions of Federal Decree Law No. 9 of 2022. This law ensures the rights and well-being of domestic workers by prohibiting:

  • Employment of individuals under the age of 18.
  • Discrimination based on race, color, gender, religion, or nationality.
  • Any form of sexual harassment, whether verbal or physical.
  • Forced labor or human trafficking.
  • Exposure to physical harm.
  • Assigning tasks that are not specified in the employment contract.

The law emphasizes fairness and protection in the workplace, creating a safe and respectful environment for domestic workers.

Under the Federal Decree Law, domestic workers in the UAE are entitled to several benefits and protections to ensure their well-being. These include:

  • Timely payment of wages as specified in their standard contract, within 10 days of the due date.
  • One paid rest day each week.
  • 12 hours of rest per day, including 8 consecutive hours of uninterrupted rest.
  • 30 days of paid annual leave.
  • A round-trip ticket to their home country every two years.
  • Up to 30 days of sick leave annually.
  • The right to retain possession of their personal identification documents, such as passports and IDs.

These entitlements aim to safeguard the rights of domestic workers and provide a supportive and respectful working environment.

Employers must follow the terms of the employment contract and ensure the following for domestic workers:

  • Necessary facilities to perform their duties efficiently.
  • Suitable accommodation.
  • Meals and clothing.
  • Timely payment of wages.
  • Medical care or health insurance.
  • A safe and respectful working environment.
  • Compensation for work-related injuries and illnesses.

Domestic workers must adhere to the employment contract and fulfill the following responsibilities:

  • Perform their duties under the employer’s supervision as stated in the contract.
  • Work with care and diligence.
  • Avoid being absent without a valid reason.
  • Respect the customs and traditions of the UAE.
  • Follow the employer’s instructions related to the agreed-upon work.
  • Safeguard and properly maintain items in their possession.
  • Respect the privacy of the workplace.
  • Keep tools and items in their designated places within the workplace.
  • Provide help during emergencies or hazards that may affect the workplace or its occupants.

Employment T&C

Yes, domestic workers can be assigned tasks on their weekly rest day, but the employer must compensate them by either granting an alternative rest day or paying them for the missed day. However, a domestic worker cannot be required to work for more than two consecutive rest days within a two-week period, unless otherwise agreed upon.

A domestic worker is entitled to at least 30 days of paid annual leave for every year of service, with full payment provided before the leave begins. For service between six months and one year, the worker is entitled to two days of leave per month.

However, the employer decides when the annual leave starts and may divide it into two parts if necessary, depending on the circumstances.

If a domestic worker chooses to spend their annual leave in their home country, the employer is responsible for covering the cost of a return ticket once every two years. However, if both parties agree to terminate the contract after the annual leave, the employer will only cover the cost of a one-way ticket home.

Yes, domestic workers are entitled to 30 days of sick leave per year, which can be taken continuously or intermittently, provided a medical report from an approved health authority confirms the need for leave. The sick leave is calculated as follows:

The first 15 days are fully paid. The next 15 days are paid at half salary.

Domestic workers must have at least 12 hours of rest each day, including 8 consecutive hours of uninterrupted rest. Time spent eating or taking breaks does not count as part of their actual working hours.

However, if the illness is caused by the domestic worker’s own behavior, no payment will be made during the sick leave.

Yes, domestic workers can work for the employer's relatives up to the second degree, but only if the domestic worker has given their consent to do so.

A domestic worker will not be granted a new work permit until one year has passed since her departure from the UAE in the following cases:

  • If an absconding report against her is found to be accurate.
  • If she is found intoxicated or under the influence of drugs during working hours, either admitted by her or proven by authorities.
  • If she is convicted by a court for an offense involving dishonesty, morality, or public decency.
  • If she commits an assault against her employer or their family, whether admitted or proven by authorities.
  • If she violates workplace privacy by taking and sharing photos or videos publicly, either admitted or proven by authorities.
  • If she is absent without a valid reason for more than 15 non-consecutive days or more than 10 consecutive days.

Yes, an employer can request a recruitment office to hire a specific domestic worker by name, even if the worker is not on the office's registered list. However, in such cases, the employer will not be eligible for the two-year guarantee on the domestic worker.

Conflict Resolution

An employer must file an absconding report within five days if a domestic worker abandons their job without a valid reason.

Yes, domestic workers are allowed to stop working without prior notice in the following circumstances:

  • If their salary is reduced from the amount agreed upon in the employment contract.
  • If the employer fails to meet their contractual obligations as stated in the employment contract.

If a dispute arises between an employer and a domestic worker and cannot be resolved amicably, the case must be referred to the Ministry of Human Resources and Emiratisation (MoHRE). If MoHRE cannot resolve the matter within two weeks, it will be referred to a court along with MoHRE’s recommendations. Workers’ cases are exempt from court fees at all stages of litigation and are prioritized for speedy resolution.

A domestic worker must file a labor complaint with the court within 14 days from the date the Ministry approves its referral to the judiciary.

If a dispute arises between an employer and a domestic worker, the Ministry of Human Resources and Emiratisation (MoHRE) handles it as follows:

  1. Referral: The dispute is referred to the relevant department in the Ministry or an authority designated by the Ministry.
  2. Notification: The concerned department summons both parties using the address provided in the complaint or, if unavailable, the address in the Ministry's records.
  3. Reconciliation: After hearing both sides, a legal advisor attempts to resolve the issue through reconciliation based on the Ministry's rules.
  4. Court Referral: If no agreement is reached, the Ministry refers the case to the appropriate court within two weeks, including a memorandum with the legal opinion.
  5. Updates: The complainant must update the Ministry on the progress and outcome of the case.

These steps ensure disputes are handled fairly and transparently.
